The Olean Common Council on Tuesday approved a plan for the contractor of the War Veterans Park splash pad to fix it by the end of November.
After city officials said last month the splash pad did not meet specifications, Mayor Amy B. Sherburne worked out a memorandum of understanding with the contractor, PV Paving & Concrete of Smethport, Pa.
Under the MOU, the company has 30 days to complete the concrete removal and replacement, plus another 10 working days after that, said Common Council President Lawrence “Jr” Bennion, R-Ward 1.
That puts the deadline for completing the project on Nov. 13. Bennion suggested the council’s resolution read Nov. 30, to allow for weather-related delays. The terms of the MOU remain unchanged.
“I assume they will be agreeable to it,” Sherburne told the aldermen. All six aldermen voted to approve the resolution as amended. It states: “the quality of workmanship is
unacceptable and does not meet the requirements or standards expected.”
The city had been ready to declare the splash pad project in default and proceed with a lawsuit.
Under the terms of the MOU, PV Paving and Concrete and
PGV Paving submitted the low bid of $459,540 for the splash pad construction and installation in May 2024. It was expected to open the following year. The Common Council had purchased the splash pad equipment for $800,000 in 2022 using Covid 19 funding.
PV Paving & Concrete and the city’s engineering firm, CPL, an architecture, engineering and planning firm with an office in Buffalo, are expected to fix the problems with the splash pad.
Adjacent to the splash pad is the city’s swimming pool, which is currently unusable. It was last used in 2023. The following year, the Cattaraugus County Health Department did not allow it to open due to a failed sand filter.
The Common Council approved a $1.1 million bid this summer to make the necessary repairs despite concerns that there could be more damage than was apparent. The mayor vetoed the resolution, and the council overrode the veto.
No work has started on the pool yet. It’s unclear what the timeline is on the pool project.
